Their son tragically passed away following a drowning accident at their home in Arizona.
The three-year-old was rushed to Chandler Regional Hospital in critical condition following the incident at their family home. He was later transferred to Phoenix Children’s Hospital but sadly passed away from his injuries on May 18th.
Chandler police have confirmed that they have completed their investigation into Trigg's untimely passing.
They stated: "Following a thorough review of the evidence, investigators have recommended a Class 4 felony charge of child abuse against Brady Kiser."
The case has been submitted to the Maricopa County Attorney's Office for review.
According to court records, the three-year-old’s death has been labelled an ‘accidental drowning.’
A source told People that Kiser was not home at the time of the drowning.
The update comes after Emilie Kiser filed a lawsuit against multiple Maricopa County public offices to keep records of her son’s death private.
According to NBC News, Kiser filed a lawsuit to keep details of her son’s death out of the public eye.
The suit was obtained by NBC News.
It reads: “Emilie and her family desperately want to grieve in private, but sadly, the public will not let them. Trigg’s death has become a media frenzy.”
“Disclosure of graphic or intimate death-related records causes renewed trauma to surviving family members and violates their right to grieve privately.”
It is believed that 100 public records requests have been filed since Trigg’s tragic death.
Kiser has not reviewed any of the requested records.
