The Kneecap star will appear in Westminster Magistrates' Court in London later today.
Liam Óg Ó hAnnaidh, whose stage name is Mo Chara, was charged with a terrorism offence last May for allegedly displaying a flag in support of Hezbollah one of their gigs last year, a charge that he has denied.
The 27-year-old appeared before Westminster Magistrates' Court in June and was granted unconditional bail.
His legal team argued that the terrorism charge brought against him was taken after the six-month limit to bring such a charge, and so it is their argument that the case should be dropped.
The matter will be decided in court today.
London's Metropolitan Police said the terrorism offence allegedly occurred at a gig last November at the O2 Forum in north London.
The Kneecap star is accused of displaying a flag 'in such a way or in such circumstances as to arouse reasonable suspicion that he is a supporter of a proscribed organisation'.
He denies this and described the charge as 'political', insisting that the flag was thrown on stage.
Further, Kneecap labelled the charge a 'carnival of distraction' from the genocide in Gaza.
Ahead of his appearance, a crowd of well-known activists and artists are expected to gather outside the court today.
