Sofía Vergara’s ex can’t use embryos without her consent, says court

The court battle has been ongoing for years.

Sofía Vergara's ex Nick Loeb will not be able to bring her frozen embryos to term without her consent, a court has said. Vergara was granted an injunction this week by a Los Angeles Superior Court judge, banning Loeb from using the two frozen embryos without his ex's "explicit written consent." According to court documents as reported by Page Six, the injunction will stop the businessman from “unilaterally asserting any claim(s) by or on behalf of the Embryos to seek relief for the purpose of unilaterally bringing the Embryos to term without Vergara’s consent." This comes after Loeb appealed a decision by a Louisiana court banning him from retaining full custody over the embryos.  The appeal was dismissed by the Fourth Circuit Court of Appeal last month, who stated that the case against Vergara was "weak." The court said that Loeb had been "forum shopping" in a bid to find a State that would be sympathetic to his case against his ex. Loeb and Vergara had previously undergone IVF treatment in California. Loeb has been battling for custody of Vergara's embryos for years. He first sought custody to bring the two embryos to term using a surrogate, giving the embryos names - Emma and Isabelle - in court. In a 2015 op-ed for the New York Times, he argued that “keeping them frozen forever is tantamount to killing them." Vergara, who is best known for her iconic role as Gloria Delgado-Pritchett in Modern Family, got engaged to Loeb in 2012. The couple decided to undergo IVF to freeze their embryos before splitting in 2014. They have been involved in multiple lawsuits regarding the two embryos since this time. Vergara has been married to actor Joe Manganiello since 2015. Loeb now has a daughter with another girlfriend, who reportedly lives in Europe.
